AFAIK, both Ukraine and Russia have not signed the Convention on Cluster Munitions. Plus, Ukraine has been using cluster munition repeatedly and it has been well-documented.

How decides what's banned and what's not? America has not signed the convention either [0]. It's a similar situation with Depleted Uranium munition, which America used in Yugoslavia, and which was blamed for the increase in lung cancer incidence and deaths.
