I don't know for certain, but I think that IE, Chrome, others asked NYT for permission and don't just go ahead and use the RSS feed.

No, not really. I personally think this whole mess is because they pre-packaged NYT RSS feeds and also used that in their screenshots (don't know that last point for sure, but I think thats the case?)…

True. At that point it comes down to a level of trust. Do you trust the organization based on your knowledge and experience. In this case I would say Yes. For many others I would say No.
